Constitution & By-Laws_
ARTICLE 1 NAME
The name of this association shall be "Motor City Chiefs Junior Hockey Club Inc." and may be referred to as "M.C. Jr. Chiefs".
ARTICLE II PURPOSE
•A. The promotion and development of ice hockey thru teaching the game. •B. The development of the upper talented players to prepare them for the higher levels thru the best coaching possible.
ARTICLE III OFFICE
The office of this private association shall be located at 27938 Cooke Street Flat Rock, Michigan 48134. We are a State of Michigan, Oakland County Corporation.
ARTICLE IV NON-PROFIT
We are Tax-Exempt non-profit status as a 501c3 Corporation.
ARTICLE V MEMBERSHIP
All Board Members, Directors, Coaches, Assistant Coaches, Managers, Players, Parents or guardians shall be consider members of this association as long as they are in good standing.
ARTICLE VI BOARD OF DIRECTORS
The Board of Directors shall consist of the President, Vice-President, Treasurer, and Secretary. These positions will be filled by the Ownership of the Motor City Chiefs Junior Hockey Club Inc. and any others they deem necessary to continue the mission statement of teaching and providing the proper development of youth players. All board members shall have one vote per issue requiring a vote.
ARTICLE VII MEETINGS
Meetings shall be called at the pleasure of the Board of Directors when they deem necessary. At such time and deemed necessary, the entire membership will be invited to attend an open Board Meeting.
ARTICLE VIII ELECTION
There will be no elections for Board positions but the board will invite any person willing to donate their time.
ARTICLE IX OFFICERS
The officers of the Association shall include the, President, Vice-President, Treasurer, and Secretary who are either the Principles of the Motor Chiefs Junior Hockey Club Inc. or appointed Officers to fill necessary positions.
Duties of the Officers: Responsibility for all league operations. Responsibility for the day to day operations. Preside at all meetings. Maintaining a direct communication with all vendors of the M.C. Jr. Chiefs. Working with M.A.H.A. & USA Hockey
ARTICLE X BINDING CONTRACTS
The only Principle Officers of the Motor City Chiefs Junior Hockey Club Inc. are the only and sole parties authorized to bind the M.C. Jr. Chiefs. to any written contracts and or obligations.
ARTICLE XI MEMBERSHIP
Membership requirements shall be completed when a Motor City Chiefs Junior Hockey Club Inc. registration form is completed and turned in with their deposit check. Player or Parents or Guardian are not considered members in good standing until this form and payment is complete. To maintain membership in good standing all required payments shall have been executed thru the legal banking system.
ARTICLE XII PARTICIPATION BY OTHERS The Motor City Chiefs Junior Hockey Club Inc. welcomes all interested parties to volunteer their expertise and time to achieve the goal of developing and improving the skills of the youth players in this association.
ARTICLE XIII EMPLOYEES
When determine by the Board of Directors, they shall employ paid help to assist in the day to day operations of the M.C. Jr. Chiefs to achieve it's stated goal to develop and improve our youth players skills.
ARTICLE XIV Disputes & Hearings
The Principle Officers of the Motor City Chiefs Junior Hockey Club Inc. shall be the committee to deal with all Disputes, Problems, Grievances ect. arising under the policies of this Association and Parent Corporation.
ARTICLE XV FISCAL YEAR
The fiscal year end shall end on the 30th day of June in each year unless otherwise determine by the Principle Board Members.
ARTICLE XVI AMENDMENTS
The provisions of this constitution may be amended anytime by the Board of Directors by a simple majority vote.
BY-LAWS
Article 1 PLAYERS
A participant in the Motor City Junior Chiefs Hockey Program who has registered and is willing to abide by the rules and regulations of the M.C. Chiefs shall be considered a player.
•1. Conduct All players participating in the M.C. Jr. Chiefs program shall conduct themselves in a proper manner at all times. They shall be subject to the authority and discipline of their respective coaches, assistant coaches and managers. All players, family friends must abide by the rules of hockey as it pertains to good sportsmanship, image and the rules and regulations established to govern the M.C. Jr. Chiefs.
•2. Dues All players will be assessed season dues, which are to be used in meeting the financial obligations of the M.C. Jr. Chiefs as determined by the Board of Directors. Failure to pay in accordance with the terms prescribed by the Board of Directors shall result in a player being denied further participation until such time as payment is made. The Motor City Chiefs Junior Hockey Club Inc. reserves the right to use whatever means necessary to collect a debt owed including but not limited to legal process to collect said debt, restraining participation in any MAHA/USA Hockey sanctioned activities.
•3. Roster A player signing a roster is committing to play for a team in the Motor City Jr. Chiefs and will hereby be required to not communicate thru themselves or an agent (parents, friends ect.) with any other USA Hockey/MAHA sanctioned teams. Tampering rules will prevail and the Motor City Chiefs Junior Hockey Club will use those rules to defend our position.
•4. Attendance Participation in all schedule activities of your team is mandatory to participate in the games. The Coach shall determine if participation in the activities of the team are at his discretion.
•5. Leaving Program Any player leaving the Motor City Jr. Chiefs Hockey Club Inc. shall pay the entire seasons' fees due their respective teams. Then and only then will a player be released to seek another program. Upon, the respective team acquiring a new player a pro-rated amount of the team fees will be returned to the player that has left the program. All fundraising activities shall remain with the players' respective team.
•6. Player Selection All players will be selected by the Coaching Staff of the team that the player is trying out for. The criterion for selection is solely the responsibility of the Coaching Staff.
ARTICLE II Sanctioned State & National Tournaments
All Motor City Jr. Chiefs Hockey Club Inc. teams will participate in the sanctioned MAHA/USA Hockey State of Michigan Tournament. The exception is when 2 teams from the same association and in the same competitive level must have a best 2 of 3 play-down to determine the representative to the State Tournament.
ARTICLE III Coaches & Managers
All Coaches shall be selected by the Director of Development AAA Program. The Director shall have the ability to gather outside help in determining the best Head Coach for that team. The head Coach shall select his own staff and the conduct of that staff shall be his responsibility. The Board of Directors or the Director of Development AAA Program shall have the right to suspend, change or terminate any Coach or a Coaches staff member for any reason.
ARTICLE III SCORESHEETS
A copy of the game sheet shall be forwarded to the statistician within 48 hours of completion so that accurate stats can be viewed on the web-site.
ARTICLE IV DECORUM
At all times, members of the Motor City Junior Chiefs Hockey Club Inc. shall conduct themselves in a manner representative of well behaved athletes. The player shall conduct himself as he would in other situation that will not bring disgrace to his teammates, his team, his Coaches or his club. Any violation of this Article IV will be dealt with by the Director of Development AAA Program and/or the Board of Directors.
ARTICLE V SPONSORSHIP FUNDS
No outside checkbooks or accounts are allowed while the teams, players, coaches are members of the Motor City Chiefs Hockey Club Inc. organization. If it is determined that a violation of this mandate is true, an immediate dismissal of the Head Coach and all involved parties will take place. The terminated parties may request a meeting with the Director of Development AAA Program and the Board of Directors Motor City Chiefs Junior Hockey Club Inc. to present information why they should not be terminated. That committee has the right to overturn the termination and re-instate the parties involved. All fundraising monies earned by a team shall have full use of that money for their teams extra activities. This money shall stay with the Coach until such time that the team dissolves and an even allocation of funds after all expenses are paid shall be refunded to all currently rostered players.
ARTICLE VI LIABILITIES
No Coach, Assistant Coach, Manager, player or association member can incur any liability on behalf of the Motor City Chiefs Hockey Club Inc. or its entities. No appointed Directors or Officers can incur any liability on behalf of the Motor City Chiefs Hockey Club Inc. or its entities. This shall include but not limited to equipment, clothing, games, ice time ect.
